Terms and Conditions of Sale
Nero Vesuviano — Online Shop

1) Site and Contract Owner
The e-commerce site Nero Vesuviano (the “Site”) is managed by:

(“Seller” or “Owner”).
These details are provided pursuant to Legislative Decree. 70/2003.
2) Scope of Application
2.1. These conditions govern the remote sale of food products (e.g., preserves, oils, powders, wines) and non-food products (accessories, gift cards) to Consumers and, where expressly provided, to Professionals (B2B).
2.2. “Consumer”: a natural person acting for purposes unrelated to business or professional activity; “Professional”: an entity acting in the exercise of their business activity.
2.3. Contract language: Italian. Currency: euro (EUR).
2.4. Delivery areas: Italy (excluding minor islands/remote areas according to courier conditions).
2.5. Placing an order implies full acceptance of these conditions.
3) Product Information, Labeling, and Allergens
3.1. Nero Vesuviano products are selected in numbered micro-lots; availability is limited and subject to restocking.
3.2. Product sheets provide mandatory information (ingredients, allergens, net quantity, batch, BBD/expiry, origin where required). The images are illustrative and may differ from the actual packaging.
3.3. Allergens and safety. The binding information is on the label; the Customer must always read it before consumption.
3.4. Perishable/fresh products (if present) require fast delivery and may be excluded from withdrawal (see art. 12).
3.5. Alcoholic beverages: sale to minors under 18 is prohibited; age checks may be conducted at order and delivery (art. 11).
4) Prices, VAT, and Discount Transparency
4.1. All prices are expressed in euro and are inclusive of VAT, unless otherwise indicated.
4.2. Shipping costs and any additional charges (e.g., remote areas) are shown at checkout before confirmation.
4.3. Obvious price error: in case of discrepancies/typos, the Seller will inform the Customer; the order may be canceled with a full refund or confirmed at the correct price.
4.4. Price reduction announcements (Omnibus): when applicable, we indicate the lowest price offered in the 30 days preceding the discount (subject to legal exceptions, particularly for perishable food items).
5) Account and Data Accuracy
Purchases can be made as a guest or by registering. The Customer guarantees the truthfulness of the provided data (personal details, address, email; SDI/PEC for B2B invoices). It is prohibited to use someone else’s identity or the Site unlawfully.
6) Conclusion of the Contract and Availability
6.1. Steps: (i) cart; (ii) data; (iii) shipping/payment; (iv) review; (v) order submission.
6.2. The order acknowledgment email does not constitute acceptance. The contract is finalized with the shipping confirmation email and/or upon handover to the courier.
6.3. Subsequent unavailability: communication to the Customer with a full refund of the relevant amount or proposal of an alternative product.
7) Payments
7.1. Accepted methods: Stripe (cards), Klarna (where available), PayPal.
7.2. Bank transfers and cash on delivery are not accepted.
7.3. Payments are processed on secure connections by the respective Payment Service Providers; the Seller does not store card data.
7.4. Klarna installment/deferred solutions (if active) are offered by Klarna Bank AB (publ) under their own terms; the outcome of the assessment does not depend on the Seller.
8) Invoicing
Consumers: fiscal receipt.
Professionals/Companies: electronic invoice upon request at checkout (required: header, VAT number, SDI/PEC). Incorrect/missing data may prevent subsequent issuance.
9) Shipping, Delivery, and Risks
9.1. Couriers: SDA, BRT, GLS, TNT, FEDEX with tracking.
9.2. Indicative times: preparation 1–2 working days; delivery 24/48 hours (except islands and special destinations/remote areas). Times may vary due to peaks, force majeure, or carrier delays.
9.3. The Customer guarantees an attended address during working hours. Failed delivery due to absence/wrong address → possible storage costs or new shipment.
9.4. Transfer of risk: for Consumers, upon delivery to the Customer or a third party designated by them (other than the courier). If the Customer entrusts the shipment to a courier not proposed by the Seller, the risk passes upon delivery to the courier chosen by the Customer.
9.5. Upon delivery, check package integrity and number of packages; in case of damage/tampering, accept with specific reservation and take photos.
10) Transport damage and anomalies
Any damage, errors, or shortages must be reported to shop@nerovesuviano.it (or via PEC) within 48 hours of delivery, attaching photos of the external/internal packaging, label, and product, with the order number. This does not limit legal rights.
11) Sale of alcoholic beverages — 18+
11.1. The sale of alcoholic beverages to minors under 18 is prohibited.
11.2. The Customer declares to be 18+ and accepts possible age verification; the courier can also deliver only to adults.
11.3. If verification fails or the recipient is underage, delivery will not occur; shipping/storage costs may be charged.
12) Right of withdrawal (Consumers only)
12.1. The Consumer can withdraw within 14 days of delivery, without providing reasons.
12.2. To exercise the withdrawal, send a clear communication to shop@nerovesuviano.it (we also accept PEC). You can use the standard form (art. 20).
12.3. Refunds: we will refund all payments received for returned products, including initial standard shipping costs (if charged), within 14 days of notification; the refund may be withheld until receipt of goods or proof of shipment.
12.4. Return costs: borne by the Customer, unless otherwise indicated; the Customer is responsible for the decrease in value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
12.5. Exceptions to withdrawal: withdrawal is not provided for:
– perishable goods or those at risk of rapid deterioration;
– sealed goods not returnable for hygiene/health reasons and opened after delivery;
– customized/made-to-measure goods;
– supply of alcoholic beverages with delivery over 30 days and price linked to market fluctuations beyond the Seller’s control;
– other cases provided by law.
13) Returns: operational instructions
13.1. Before shipping the return, wait for instructions from shop@nerovesuviano.it (RMA/label).
13.2. Pack carefully, indicate order number and name; ship to Micco 35, 80049 Somma Vesuviana (NA).
13.3. Tracking and insurance on the value are recommended.
14) Warranties and compliance
14.1. Consumers (B2C): the legal warranty of compliance applies (arts. 128–135-septies Consumer Code). Remedies: repair or replacement, and alternatively price reduction or termination; the peculiarities of food products (expiration, proper storage) and exclusions for improper use/negligence remain firm.
14.2. Professionals (B2B): the consumer warranty does not apply; the civil code and/or any conventional warranties expressly indicated apply.
15) Promotions, discount codes, and gift cards
15.1. Promo codes: not combinable unless otherwise indicated; have specific expiration and scope; not convertible into cash.
15.2. Gift cards: prepaid value, use only on the Site, valid for 6 months, not rechargeable or refundable in cash; in case of return, the amount goes back to the same card.
15.3. The Seller may refuse orders exceeding quantities attributable to non-domestic use or resale.
16) Reviews, ranking, and transparency
16.1. Any published reviews refer to verified Customers (confirmed purchase) or participants in events/tastings; we indicate on the page if and how verification occurs.
16.2. Search results and product lists are not personalized through individual profiling; where ranking algorithms are used, the main parameters (availability, novelty, sales, promotions) are indicated on the page.
16.3. Any personalized prices (dynamic) will be clearly indicated.
17) Limitations of liability
Except for willful misconduct or gross negligence, the Seller is not liable for:
(a) interruptions of the Site for maintenance/updates/force majeure;
(b) delays/non-fulfillment due to causes not reasonably foreseeable or controllable;
(c) improper/non-compliant use of the Products (e.g., failure to comply with storage and expiration).
18) Intellectual property
Trademarks, texts, images, and content of the Site are owned by Nunzio Saviano or the respective holders and protected by current regulations. Unauthorized reproduction is prohibited.
19) Prohibition of resale and abnormal purchases
Purchases are intended for domestic use (unless B2B is agreed). The Seller may cancel suspicious orders (multi-account, bot, abnormal quantities, resale).
20) Standard withdrawal form (to be used only if you intend to withdraw)

21) Complaints, ADR, and Dispute Resolution
21.1. Complaints: write to shop@nerovesuviano.it (or to the PEC).
21.2. ADR (Alternative Dispute Resolution): the Consumer can contact ADR bodies listed in public registers for a quick out-of-court solution.
21.3. EU ODR Platform: please note that the ODR platform was discontinued in 2025; national ADR tools and ordinary legal remedies remain available.
21.4. Competent Court: for the Consumer the court of their place of residence or domicile is competent; for the Professional (B2B) the Court of Nola is exclusively competent.
22) Applicable Law and Partial Nullity
The contract is governed by Italian law. The nullity/ineffectiveness of a clause does not entail the nullity of the remaining clauses.
23) Retention of Title
The ownership of the goods remains with the Seller until full payment of the price.
24) Privacy and Cookies
The processing of personal data is carried out according to the Site’s Privacy Policy and Cookie Policy (Owner: Nunzio Saviano – Tax Code: SVNNNZ83M13C495K).
25) Changes to the Terms
The Seller may update these Terms for regulatory/organizational needs. The current version is published on the Site with the update date (at the top).
